Why your gym might be liable for your injury

| Apr 19, 2018 | Blog |

Working out in a gym always comes with risks, especially when you are pushing your body to the max. But when an injury occurs that you believe was beyond your control, you might wonder if it’s possible to blame the gym for the painful consequences that occurred.

When you experience an injury in a Michigan gym, you may have needed to take unpaid medical leave as a result, and incurred rehabilitation costs. If it can be proven that the gym itself is liable for the accident that occurred, it is quite likely that you will be able to recoup these damages, as well as gain compensation for the pain and suffering that you had to endure.

What legal responsibilities do gyms have?

Gyms, as a public premises, must ensure that the environment that they provide to guests is kept reasonably safe at all times. This means that there should be staff on duty to make sure that equipment is cleaned and maintained, and to ensure the safety of the environment. They must prevent wet floors, slips and trips over misplaced dumbbells and other equipment.

However, gyms will never be liable for behavior that was reckless or careless on your part. For example, injuring yourself because of using a weight that is too heavy will not be the fault of the gym.

What are some examples of situations when a gym would be responsible?

If you contracted an infection from unsanitary gym equipment, it is likely that you will be able to make a successful claim if you can prove the cause. In addition, becoming injured by faulty equipment that does not display an “out of order” sign can also be a valid reason to file a legal claim against the gym. It might alternatively be appropriate to file a legal claim against the equipment manufacturer if there was a fault that was not possible to detect by the gym managers.

What should I do if I have been injured at a gym?

If you have been injured at a Michigan gym, it is important to consider whether you believe that the gym could have prevented the accident. If you believe that this is the case, you should waste no time in taking action.
